LATIN ID S.A. DE C.V. (“Latin ID”), located at Gobernador Rafael Rebollar 67, Col. San Miguel Chapultepec, Mexico City, Zip Code 11850, website http://www.latinid.com.mx, is a legally incorporated business entity under Mexican law. Its main activity is the provision of electronic signature tools and identity verification services. Latin ID is responsible for the use and protection of your personal data, and in this regard, we provide the following Privacy Notice (the “Privacy Notice”) and inform you of the following:

 

PURPOSE

The personal data we collect from you will be used for the following purposes, including but not limited to, those necessary to provide the services you request:

General Data: To identify and locate you; send communications related to the service provided; contact you; send information relevant to the legal relationship; provide requested information; as well as all activities and events related to the service; video surveillance as a security and crime prevention measure.

This data may be collected through various means, whether in written and/or technological form, including video recording, image capture, and scanning of identity-related documents using software.

Additionally, data collected from our clients through our web applications, desktop applications, mobile applications, or any other proprietary software may be transmitted through these tools.

Financial Data: Used as reference for credit granting.

We may also use your information for the following secondary purposes, which are not essential to the requested service but allow us to offer better service: marketing or advertising; sending news, updates, and promotional materials.

LIMITATION

If you do not wish for your personal data to be used for the secondary purposes mentioned above, you may revoke your consent by sending an email to: avisodeprivacidad@latinid.com.mx, specifying the applicable option.

Refusal to allow your data to be used for secondary purposes will not be grounds for us to deny the products or services you request or contract with us.

INFORMATION

The personal data we collect includes:

a) General Data: Full name, date of birth, gender, handwritten signature, photo ID, CURP (Unique Population Registry Code), work and personal phone numbers (landline and mobile), full address (home or work), personal or work email address, voter ID, personal references, video recordings, IP address, electronic signature files (.cer, .key, and/or .pfx), geolocation (GPS coordinates), image capture, and all data generated by the legal, commercial, or demonstration relationship of our services or visits to our offices. In the case of legal entities, relevant official documents accrediting legal status.

b) Financial Data: Account balances, credit references, income sources, income amounts and flows, debts, debtors, creditors, credit bureau information, commercial and banking references, financial statements, numbers linked to bank accounts, credit and/or debit cards, account or cardholder names, account number and issuing bank, CLABE (as applicable), credit or debit card number, card expiration date, card type and security code, and all data arising from the legal relationship. All such data is stored with your express consent and is necessary for the legal relationship.

c) Biometric Data: Fingerprints, iris scans, facial recognition, voice data, vascular data, behavioral data (e.g., signature or keystroke dynamics).

Personal data collected by Latin ID is protected through appropriate administrative, electronic, and physical security measures against damage, loss, alteration, destruction, unauthorized use, access, or processing, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its regulations. We also inform you that we are a trained and certified company in personal data protection.

DATA TRANSFERS

Your personal data may be transferred to third parties, both within and outside of Mexico, when necessary to fulfill the purposes described in this Privacy Notice, including companies providing the following services: facilities, analytics, accounting, legal advisory, and payment gateways.

We may also transfer your personal data to third parties, national or foreign, when such transfer is required by law, treaty, authority request, or court order.

SECURITY

The personal data you provide through various forms, applications, tools, web portals, and services offered by Latin ID is protected by Latin ID and/or third-party security professionals hired by Latin ID. This is done through strict security mechanisms to prevent unauthorized access to your personal data and to ensure that it is not used for purposes other than those authorized by you and described in this Privacy Notice.

Latin ID is committed to taking necessary measures to safeguard all collected information using security technology and access control procedures. However, no data transmission or security system that Latin ID does not fully control or that depends on the internet can be completely secure.

ARCO RIGHTS

You have rights over your personal data, known as ARCO rights: Access, Rectification, Cancellation, and Opposition. You may exercise any of these rights at any time, limit the use or disclosure of your personal data, object to the secondary uses of your data, or revoke the consent granted for having a commercial, legal, or visiting relationship with our company. To do so, send a request to: avisodeprivacidad@latinid.com.mx, or submit a written request to the following address: Gobernador Rafael Rebollar 67, Col. San Miguel Chapultepec, Mexico City, Zip Code 11850, Monday to Friday, from 9:00 a.m. to 6:00 p.m., addressed to the Data Protection Officer.

Your request must include:
(I) Full name of the data subject
(II) Email address for notifications
(III) Documents proving identity or legal representation
(IV) A clear and precise description of the data and the ARCO right to be exercised
(V) Any element to help locate the data
(VI) An email address to receive a response

If your request does not meet the above requirements, the Data Protection Officer may request additional documentation within five business days.

Response times will follow the provisions of the LFPDPPP and its Regulations.

The exercise of ARCO rights is free of charge. However, you may be asked to cover reasonable shipping or reproduction costs. If the same individual submits repeated requests within 12 months, charges may apply, with costs disclosed via email and capped at ten days of the current Mexico City minimum wage, unless significant changes to the Privacy Notice justify new requests.
